LONDON (AP) — British pharmaceutical company Bayer said it will pay a record $200 million in a lawsuit against the U. S. Food and Drug Administration for illegal marketing of the erectile dysfunction drug Viagra in the United States. The company says it will pay the court ordered by a federal court in the United States.
Bayer will pay $200 million, including $6 billion in penalties and $15 billion in damages, a company spokeswoman said, citing a spokeswoman for the U. District Court in Delaware.
The suit names as defendants the GlaxoSmithKline Plc, Bayer, Abbott, Glaxo's New York-based drugmaker, and Glaxo's New Jersey-based pharmaceutical company, which has a U. patent on Viagra. Bayer and its New York-based company are suing the government for its alleged marketing practices.
The suit comes after a court in Manhattan in New York ruled that Bayer's drugmaker's marketing campaign against U. consumers had been tainted by an unauthorised sale of Viagra by GlaxoSmithKline. The suit also claims that the companies were marketing the drug in an unlicensed manner.
"Viagra was approved by the Food and Drug Administration and it is an unlicensed drug, but GlaxoSmithKline believes that the company is making a marketing campaign that is not authorized by the FDA," said David P. Leach, a lawyer with Leach Law Group, an arm of Leach & Co.
Bayer says it has already taken legal action against GlaxoSmithKline and other U. marketers for promoting Viagra in its online pharmacy. GlaxoSmithKline's website is linked to a link to the site of a company called Viatris that sells Viagra in the United States. "The site has been linked to a link to the site of a GlaxoSmithKline site and it's being used to promote Viagra," said David P. Leach, a lawyer with Leach Law Group.
Bayer was the world's largest generic drug maker, with annual sales of $1.6 billion. Its U. patent expires in 2006.
The company said that while the suit was not a legal suit, the company believes it was a proper legal suit.
The suit, which is being pursued by the United States government, said GlaxoSmithKline's marketing campaign against U. consumers had been tainted by unauthorised sale of Viagra.
"The FDA, in its investigation of this case, has asked that the court order the company to pay damages," said Michael Reif, a spokesman for the U. government.
Bayer did not immediately respond to a request for comment.
The lawsuit alleges that GlaxoSmithKline and other U. pharmaceutical companies engaged in a marketing campaign to sell Viagra in violation of federal health regulations, including the Food and Drug Administration's.
The suit also seeks a judgment of $2.2 billion.
The suit was filed in the United States District Court for the District of Delaware. GlaxoSmithKline and its New York-based pharmaceutical company, Glaxo's New Jersey-based pharmaceutical company, have been accused of marketing Viagra with the company's website.
